Is it really a class C felony to wear an "I LOVE N.Y." shirt having never been to New York?

Yes. It is also a federal offense to wear a t-shirt that says "My aunt went to Las Vegas and all I got was this lousy t-shirt" if you either have no aunt or if she has never actually been to vegas.

but I would wear " I got ROBBED in NYC"

Reply:Unless wearing the shirt spurs violent reactions from the people who read it, and the person wearing the shirt wore the shirt with the express intent to produce violent reactions from people, you are fine.





The Supreme Court in Cohen v. California stated that the public is a "captive audience," subject to everyone else's written expression (this differs entirely from SPOKEN expression). The test for determining whether or not a WRITTEN expression is violent or harmful is too difficult to apply a blanket law that puts anyone who wearing a shirt stating a lie up for arrest. The Supreme Court's explanation? If we arrested everyone with a lie on their shirts, we would be arresting people whose shirts we didn't even "like," lie or not. It is simply too broad.





So, go ahead and wear your "I LOVE NY" shirt. You'll be fine.

Reply:No, silly, we still have some "freedom of speech" left in this country! Love exists for many reasons, none of which are prosecutable in a court of law.
Reply:No I used to do it all the time!! You son't have to go somewhere to love it. But since I have been there I really DO love it!!
